Your key responsibilities:
Your responsibilities include, but not limited to:
• Determine if a development program has freedom to operate from relevant third party patent rights and continuously monitor over the course of a program.
• Drafting patent strategies including the provision of invalidity and non-infringement (FTO) positions with respect to 3rd party patent rights ensuring an early launch of Gx products. Formulate FTO opinions in a professional manner considering recent legal provisions & actual applicable case law. Providing input on IP contract terms and performing IP due diligences. Includes directing, managing, and coordinating global external counsel.
• Develop an effective patent strategy that takes into account development timelines, competition, originator and Sandoz LCM concerns, and other commercial considerations to ensure earliest launch by timely technical circumvention and/or nullification of third party patents in major markets.
• Provide necessary and timely IP input for, and maintain full accountability to R&D/Licensing/M&A/Market activities
• Provide integral support to global litigation activities, including ensuring alignment of local litigation strategy with global strategy
• Conduct patentability assessments and identify inventions from development organizations.
• Draft, file and prosecute patent applications and maintain, and defend patent rights worldwide as necessary. Align such efforts within the Novartis group of organizations.
• Serve as strategic partner to client and business partners on patent and related IP issues, including communicating global patent strategy and IP risks for intended launches in an straightforward, effective manner
• Evaluate & communicate IP risks for development, BD projects and intended launches
• Demonstrates ability to consistently perform complex patent activities independently and efficiently
• Recognized as a strategic partner by the relevant clients with respect to patent activities

Minimum Requirements

What you’ll bring to the role:
• Technical degree (B.Sc. or higher) in relevant subject (Chemistry, Biochemistry or Biology) and Either Admission to practice as a National (within Europe or US) Patent Attorney and/or European Patent Attorney
• Fluent English, competency in a second language preferable
• 5 years practicing patent law, including at least first years of experience in the pharmaceutical industry
• Strong communication skills and ability to explain complex ideas simply
• Project management skills
