The Senior IP Counsel, BD&L, Strategy and Portfolio will function as a key IP advisor to the Business Development & Licensing (BD&L) and Portfolio teams and will assist these teams in driving company growth through a high volume of BD&L transactions, and internal development. The attorney will partner with key stakeholders to identify product opportunities, including review and due diligence of potential BD&L projects and internally developed products. This individual will help drive by drawing on extensive experience in the generic and biotech pharmaceutical space, including with Hatch Waxman litigation to crafting IP strategies to drive the earliest possible launch. The incumbent will also have significant interaction with senior leadership and external partners, as well as members of the Legal & IP Department.

Your responsibilities include, but are not limited to:
• Strategic review and assessment of IP and regulatory filing strategies to assist in the identification of optimized product opportunities for BD&L or internally developed products to drive the earliest possible launch
• Conduct strategic IP due diligence to support a variety of corporate transactions, including driving strategy and partnering with key internal stakeholders on same
• Provide IP transactional support on a wide variety of business transactions
• Evaluate and address third-party IP rights and advise senior management on the implications of such rights, including analyzing the validity of competitors’ patents
• Build and foster external relationships with Company’s business partners, including advising on, negotiating and drafting IP provisions of a variety of corporate agreements including M&A agreements, in-licensing or co-development agreements, and authorized generic agreements
• Provide clear and direct expert counsel on Hatch-Waxman and related patent, regulatory, exclusivity and forfeiture issues, including developing innovative strategies on same to improve growth in a manner clear for non-IP-experts
• Evaluate and assess impact of competitive space on launches from an IP perspective
• Independently manage complex projects and provide oversight of cross-functional project teams by collaborating and setting strategic priorities to accomplish organizational goals
• Proactively counsel clients about IP strategy related to internal and external projects, including assessing freedom to operate and patentability

Minimum Requirements

What you’ll bring to the role:
• Juris Doctor from a recognized, accredited U.S. law school and licensed to practice in at least one state or the District of Columbia, with the ability to be licensed as an in-house counsel in New Jersey is required
• 8+ years of relevant experience (either in-house and/or law firm setting supporting generic or biotech clients within the pharma industry) managing increasingly complex due diligence licensing and IP counseling is required
• Experience managing ANDA litigations and Hatch Waxman issues highly preferred
• Demonstrated client service orientation; recognizing and responding quickly, clearly and pragmatically to urgent situations and demanding clients; ability to work effectively in a fast-paced, demanding environment
• Strong executive presence with the ability to ability to quickly gain the trust and respect of senior executives
• Experience managing complex projects independently and providing oversight of cross-functional project teams by collaborating and setting strategic priorities to accomplish organizational goals
• Experience using sound judgment when working through complex issues, including those with significant strategic risk to the company
• Broad understanding of the business environment and anticipating future challenges
• Must be adaptable; able to respond to shifting priorities and work effectively in ambiguous or challenging situations
• Ability to work both in a strategic big picture mode, as well as tactically, including “rolling up one’s sleeves” regularly
