The SpeakUp Office is part of the Novartis Group Ethics, Risk & Compliance function and provides a safe place where anyone, internal and external, can raise concerns about unethical behavior at Novartis. By providing a safe place to flag potential issues, the SpeakUp Office contributes to the Novartis culture by building trust for our associates and society.

For the Americas Region this role manages the Novartis Group Whistleblower/ Misconduct Reporting Program in receiving misconduct and fraud allegations from internal and external sources and incorporates a reporting misconduct and investigation framework in alignment with internal (Novartis Audit and Compliance Committee) and external (Sarbanes-Oxley) requirements. It oversees all internal investigations into misconduct, ensures appropriate remedial actions and sanctions for confirmed cases. Identification of lessons learned and root causes, shared with key stakeholders from country/region/division is a key element of misconduct prevention and efficient risk assessment.

The Region Head Americas will need to have the same passion for listening to people and their concerns as members of our SpeakUp Office team.

Major Accountabilities
• Responsible for implementing the SpeakUp Office strategy in the region, acting as a role model and unbossed/ servant leader, championing and driving innovation, continuous learning and improvement.
• Manage speak-up re suspected or actual misconduct of Novartis associates or any other third party for respective region, across divisions. Facilitate and manage the process of confidential reporting for whistleblowers, including via integrity web-reporting and telephone lines by creating this safe space for people to report issues.
• Act as a key point of contact with reporters to understand background of complaint and assess whether an internal investigation is needed or referral to other function for review and handling. Act as the triage point in region for all reports of misconduct, and ensure appropriate reporting and tracking of each case in the centralized case management system to capture all allegations of misconduct in a consistent manner.
• Assess the risk of complaints, which could relate to severe Fraud, Bribery & Corruption and work closely with the Legal investigation team for any Foreign Corrupt Practices Act (FCPA) relevant matter which could harm the company and lead to government investigations, severe fines and reputational damage of the company.
• Assign investigative responsibilities to appropriate Group functions or Divisional/Business Unit management for all allegations of misconduct and oversee investigative process. Close interaction with respective local and regional senior management, People & Organization, Legal, Ethics Risk & Compliance, etc. Provide regular information to the key stakeholders (e.g. Region business management, ERC, Legal, People & Organization). Own the information and distribution of all investigation reports/ results including remediation proposals.
• Lead the discussions for confirmed cases, remediation activities and closure with respective country/region management. Provide input to and support CIA relevant reporting in close alignment with NPC ERC and Legal. Manage coordinated and consistent reporting of cases to senior management to facilitate compliance with external reporting requirements. Direct communication and training initiatives to ensure optimal awareness of and compliance with the SpeakUp program.
• Together with Global Security Investigations co-lead the internally designed investigation training for local case managers. Deliver mentoring to junior SpeakUp Office employees and mentor local case managers for their investigative activities. Presentations for national, regional or global participants to raise awareness. Oversee and contribute to the identification of root causes and lessons learned for confirmed misconduct to support mitigation and prevention and a global risk assessment.
• Ensure consistency of remedial action for Associates involved in confirmed cases of misconduct across Divisions, Business Units and geographical regions. For region of responsibility: SOX reporting, input for Audit and Compliance Committee (ACC), input for Executive Committee of Novartis presentations (ECN), input for Monthly Finance Meeting (FGC), ad hoc senior management requests. Supervise 2 Region Managers Americas, SpeakUp Office.

Minimum Requirements

Education
• Bachelors degree required. Master’s degree preferred.

Experience
• Minimum 10 years+ International experience in some of the following: Legal, Compliance, HR, Employee Relations, Commercial; fraud investigations, Audit, & Finance.
• Senior and high impact leader with strong communication skills. Strategic and entrepreneurial mindset, innovation driver and culture change-agent.
• Deep knowledge and experience in fraud/misconduct, FCPA, anti-bribery and corruption, risk management, strategic reporting. Ability to use and read data.
• Experience in handling high-volume of activity involving multiple, often complex tasks simultaneously in challenging international environment.
• Corporate savviness. Strong Customer focus and able to navigate complexity by keeping the bigger picture in mind. Experienced at creating, leading and delivering global programs.

Languages
• Fluency in English with excellent oral & written communication required. Fluency in other languages desirable.

Travel
• Up to 10-20% travel may be required, subject to business requirements.

This is an East Hanover, NJ based role. Consideration may be given for remote working arrangements in the US. (There may be exceptions based on US Legal Entity registration).
